Although I haven't a scrap of sympathy for this lowlife, I do have to say, twenty eight years is one helluva vicious sentence. But you live by the sword, you get banged up by the sword. That's the trouble I guess, you can't have a system that effectively takes lives away, a system that jails people for years on end for offences that wouldn't even see the inside of a courtroom in most civilised countries, no you can't be part of that system and then bitch about it when it turns round and bites you on the arse.

I had intended to put a couple of links in the above to one or two of the more outrageous examples of US injustice. However, trawling through the old posts, that couple grew to a few, so such examples can now be found below the main body of this post.

'Kids for cash' judge gets 28 years in Pennsylvania bribery case

The Pennsylvania supreme court overturned around 4,000 of Judge Mark Ciavarella Jr's convictions.

A long-serving judge has been ordered to spend nearly 30 years in prison for his role in a bribery scandal that prompted the state's high court to overturn thousands of juvenile convictions.
Former Luzerne County Judge Mark Ciavarella Jr was sentenced on Thursday to 28 years in prison for taking $1m (£617,000) in bribes from the builder of two juvenile detention centres in a case that became known as "kids-for-cash".
The Pennsylvania supreme court overturned about 4,000 convictions issued by Ciavarella between 2003 and 2008, saying he violated the constitutional rights of the juveniles, including the right to legal counsel and the right to intelligently enter a plea.
Ciavarella, 61, was tried and convicted of racketeering charges earlier this year. His lawyers had asked for a "reasonable" sentence in court papers, saying, in effect, that he had already been punished enough.
"The media attention to this matter has exceeded coverage given to many and almost all capital murders, and despite protestation, he will forever be unjustly branded as the 'kids for cash' judge," they said.
Federal prosecutors accused Ciavarella and a second judge, Michael Conahan, of taking more than $2m in bribes from the builder of the PA Child Care and Western PA Child Care detention centres and extorting hundreds of thousands of dollars from the facilities' co-owner.
Ciavarella, known for his harsh and autocratic courtroom demeanour, filled the beds of the private lockups with children as young as 10, many of them first-time offenders convicted of petty theft and other minor crimes.
The judge remained defiant after his arrest, insisting the payments were legal and denying he incarcerated youths for money.
The jury returned a mixed verdict following a February trial, convicting him on 12 counts, including racketeering and conspiracy, and acquitting him on 27 counts, including extortion. The guilty verdicts related to a payment of $997,600 from the builder.
Conahan, meanwhile, pleaded guilty last year and awaits sentencing. Gruniad

Mind you, they don't all get twenty eight years for their abuse of power, not in the case of Mike Nifong, North Carolina, Durham County District Attorney.
Nifong Sentenced To One Whole Day

This loathsome piece of garbage masquerading as a man. This creature really, and I mean really really, sets my blood boiling, what a piece of shit he is.

Nifong, KNOWING that the accused in the Duke lacrosse case were innocent, Nifong deliberately withheld evidence and pursued a malicious prosecution of the three for his own political advancement, trying to rack up browny points for when the time came for him to stand for re-election.

He would have sent three men up the river for life or the best part of life, he would have robbed three men of the majority of their time in their one and only visit to this planet to enhance his chances of being returned in his job as District Attorney, what an evil bastard he is.

One day! one fucking day! one miserable short day in jail, what about malicious prosecution and attempting to pervert the course of justice and Christ knows what else he is guilty of?
He should have gone up the river for at least half the time the Lacrosse Three would have served had this despicable cocksucker had had his way.

Disgusted, absolutely one hundred percent fucking disgusted.

Our next travesty features Genarlow Wilson, a sixteen year old black youth sentenced to ten years in the big house. His crime? receiving a consensual blow-job from a fifteen year old girl. I left this comment below on a law blog when I first became aware of the story. This is just one example of vicious sentencing, (and other things) I shall post another quite breathtaking case immediately below. Genarlow Wilson has his own tag.

Georgia, The Icky Factor and Gross Injustice

For a "crime" such as this, here in Britain and the rest of Europe, I think it would have been highly unlikely that a cop would even make note of it, let alone pursue it to the point of bringing it to trial.

Any such action would be met with ridicule, from the public, his peers, the prosecutor, and if it were ever to be brought before a judge there would be someone going away with a flea in his ear, and it would not be the defendant.
I have only given the case a cursory glance, but I note three factors, I am sure there are more; the kid is black, it involves the "icky" factor, which I write about in the link, and why am I not surprised, Georgia, which is also the setting for the linked story. more

Florida To Right A Terrible Wrong? : Richard Paey

This story is a shocker to say they least, it screams out about everything that is wrong with a system, I can't call it a justice system, that's the last thing it is.
I find it beyond my comprehension how this man came to be incarcerated in the first place, it truly is one of the most disgusting examples of abuse of power I have ever come across.
Florida, and no doubt other states, should hang it's head in shame that this abhorrent situation ever came to pass.

Paey also has multiple sclerosis and is confined to a wheelchair. He relies on a morphine pump provided by the state to dull his pain. The sad irony is that while Paey is allowed to self-medicate in prison, it was his self-medicating that got him there.

Paey is serving a twenty five year mandatory minimum sentence under Florida's draconian drug laws. He was convicted of drug trafficking in March of 2004 for possessing more than 100 pills. He said he needed them to treat his chronic pain. All sides conceded he never sold a single drug. Even the court of appeals for the 2nd District agreed that his sentence was unjust. So now Paey may be one step closer to freedom. more

Next up, Consensual Teen Sex And Lives Forever Ruined a similar case to Genarlow Wilson, but the gist of this article is about how the effect of Draconian restrictions imposed on a ''sex offender'' impacts the lives of the whole family. And what we mustn't forget here, you don't have to be a sex offender to end up on the sex offenders register, getting caught having a pee down an alley will do that for you.

But even if the perp is a bona fide sex offender, you could always do a lot worse in your choice of neighbours. This from an entirely different post.

A Hidden World Of Astonishing Violence: America's Brutal Prisons

....There is one thing I can say without fear of contradiction is that having suffered such systematic and institutionalised abuse over months or years the inmate on his release might just tend to be a little more anti-social than when he first entered the system, and just might be inclined to vent his anger and exact revenge on the softer target of society in general.

I have argued before about the bullshit surrounding the limitations that certain states and communities impose on sex offenders. Making a man a pariah and restricting his ability to seek employment or put a roof over his head and in some cases the heads of his family is nothing more than a recipe for disaster and if not a guarantee of re-offending then at least making the likelihood more than probable.

Yet for those that are held in the most inhumane of conditions, the Secure Housing Units or SHU's, often to include the mentally ill, banged up for twenty three hours a day, restricted severely in the kind of stimulating material that is available to them and in some institutions never seeing the light of day or being able to speak to another human being for years on end.

Statistics show that some eighty five to ninety percent of these inmates will one day be released.
Having been abused in this manner for God knows how many years they will be tossed out of the front door of the prison with no aftercare or supervision and with little or no chance of receiving any meds or anti-psychotics that they probably so desperately need, they will be left to their own devices.

Given the choice of who I would want living next door to me, the already violent con that has been incarcerated for years under such conditions or the sex offender, there's just no contest. more

Consensual Teen Sex And Lives Forever Ruined

There is little point in having a rant about this travesty so I will just make mention of something that has stuck in my craw for some fair time past, and that is this.

The sixteen year old in this story has been tried as an adult. Had he shall we say been getting laid, for want of argument, by his schoolteacher (not uncommon) then the plot shifts and he becomes the (under age) victim.

What's my point? If he is old enough to be tried as an adult perp. at sixteen then surely he is old enough not to be considered a victim when he gets it on with "Miss"

Let us for the moment move away from "sex crimes" and look at a few figures.

Twenty-three states have no minimum age. Two, Kansas and Vermont, can try 10-year-old children as adults.

About 25,000 children a year have their cases sent to adult courts instead of being tried in juvenile courts, whose convicted defendants are usually set free by the time they turn 21. more

I am not going to rant and rave, all I will say is that I find this story absolutely loathsome and utterly disgusting.

Here we have a bent cop who was, and should have been looking at thirty years, but ended up with four and a half.

Never mind that some of the innocents spent decades behind bars due to confessions beaten out of them, former Illinois Governor George Ryan released four condemned men from death row in 2003 after saying Burge extracted confessions from them using torture.

Nice huh? death row!
